These Terms of Service ("Terms") govern your use of the Inboxi platform and website at inboxi.ai (the "Service") operated by Inboxi ("we", "our", or "us"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Inboxi provides tools for Instagram outreach automation, including:

  • Cold DM campaigns — automated direct message outreach via a browser extension
  • Comment auto-replies — server-side automated DMs triggered by Instagram comments containing specific keywords
  • Lead management — collecting and organizing Instagram profiles for outreach
  • Analytics — tracking message delivery and engagement metrics

3. Account Requirements

  • You must be at least 18 years old to use the Service
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must have a valid Instagram Professional (Business or Creator) account to use automation features

4. Acceptable Use

You agree to use the Service in compliance with all applicable laws and Instagram's Terms of Use. Specifically, you agree NOT to:

  • Send spam, unsolicited messages, or harassing content
  • Use the Service to promote illegal activities, hate speech, or harmful content
  • Violate Instagram's Terms of Use, Community Guidelines, or Platform Policy
  • Attempt to circumvent rate limits, security measures, or access controls
  • Use the Service on behalf of another person without their consent
  • Resell, sublicense, or redistribute the Service without our written permission
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to collect data from Instagram users who have not interacted with your content

5. Instagram API Compliance

The auto-reply feature uses Instagram's official Messaging API (Private Replies). By using this feature, you acknowledge:

  • Private Replies can only be sent in response to comments on your own posts
  • Only one DM can be sent per comment, within 7 days of the comment being posted
  • You are solely responsible for the content of messages sent through the Service
  • Instagram may revoke API access at any time if they determine misuse
  • We are not responsible for any actions taken by Instagram against your account

6. Subscription & Payments

  • Some features require a paid subscription (Pro, Scale, or Enterprise plan)
  • Subscriptions are billed monthly through Stripe
  • You can cancel your subscription at any time from the Billing page
  • Cancellation takes effect at the end of the current billing period
  • We do not offer refunds for partial months of service
  • We reserve the right to change pricing with 30 days' advance notice

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points:

  • Instagram access tokens are encrypted at rest
  • You can disconnect your Instagram account and delete your data at any time
  • We do not sell your data to third parties

8. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Inboxi and protected by intellectual property laws. You retain ownership of the content you create and the messages you send through the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • We are not responsible for Instagram's actions, API changes, or downtime
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We do not guarantee any specific results from using the Service (e.g., response rates, sales conversions)

10. Account Suspension & Termination

We may suspend or terminate your account if:

  • You violate these Terms or our Acceptable Use policy
  • Your use of the Service generates an unreasonable load on our infrastructure
  • We receive a valid legal request to do so
  • We reasonably believe your account is being used for fraudulent purposes

You may delete your account at any time. Upon deletion, we will remove your data within 30 days in accordance with our Privacy Policy.

11. Indemnification

You agree to indemnify and hold Inboxi harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights (including Instagram's Terms of Use).

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.
